Newark Charter School will only accept five year olds into their kindergarten program

Over the weekend, Rep. John Kowalko emailed me concerning a family whose choice application was pulled from the lottery because their daughter did not turn five during a specific time frame. They were told that they would not be allowed to apply to kindergarten for the 2016-2017 school year. Newark Charter School’s board recently voted to change their admission’s policy pertaining to students who apply to Newark Charter School for kindergarten. Prior to the board’s vote, children had to be five years old at the time of admission. Below is Newark Charter School’s new policy:

All Kindergarten applicants must turn five years of age in the period from September 1, 2015 to August 31, 2016 to apply for KN in the 2016-2017 lottery

I am not sure what Newark Charter School’s reasoning is for changing their policy. There are many reasons why a family may decide to hold their child back a year from starting kindergarten. Many children have late summer birthdays, a disability, or some children just need that additional year.

This family’s child has a physical disability which impacts her fine motor skills and limits the use of her hands and arms. During a parent/teacher conference last spring, the pre-school recommended that the child be retained for an additional year. The family reached out to their feeder school and the feeder school had no objection.

The family reached out to Newark Charter School and it is my understanding the Board of Directors and the Department of Education stated that Newark Charter School followed all proper procedures.

Over the weekend, I wrote to Secretary Godowsky about this family and my concerns over Newark Charter School’s new policy only allowing students who turn five to be entered into the lottery.  I asked Secretary Godowsky if Newark Charter School’s new admission’s policy had been approved by their authorizer?  I did some researching of Title 14 and found some language that I thought would be helpful to the family –Title 14 – Chapter 27 allowed a family to delay kindergarten one year if the child had been evaulated.

Title 14 – Chapter 27 – School Attendance allows for a family to request a one year delay if the child has been evaluated. The family had their child evaluated the year before, so I assumed this part of the code would apply to them. I pointed this out to all parties involved.

The child was entered into last night’s lottery, she is on the waiting list. I am not sure who made the decision to add her name to the lottery and I am not sure why they made the decision — I am just glad the student was entered.  I still have an issue about Newark Charter School’s current policy. Why was the change made? Is it legal? If it is legal, is Newark Charter School obligated to point out the section of Delaware Code to applicants that there is an exception to their policy? I am still trying to get my questions answered.

ATTENDING A PUBLIC SCHOOL SHOULD NOT BE THIS DIFFICULT. If the family did not reach out to Rep. Kowalko, their child would have not been entered into the lottery.

(c) The following provisions shall be applicable to the administration of subsection (a) of this section in regard to compulsory attendance in the kindergarten for a child age 5 years:

 (1) If a child is a resident of the State at the time of that child’s eligibility for admission to the kindergarten at age 5, the parents, guardian or legal custodian of that child may request that school authorities evaluate the child’s readiness for attendance and may request a delay of 1 year in that attendance. However, admission to first grade will be authorized only after schoolauthorities evaluate the child’s readiness for attendance.
 

This is Exactly What is Going On Here In Delaware, Kindergarten as the New First Grade 

As I visit schools in Red Clay, I noticed that the play stations in the kindergarten classrooms are gone. When I talk with teachers, they have shared that kindergarten is no longer a place where five year olds can explore, pretend, or play. It is about worksheets, learning their A,B,C’s at record speeds, and no down time with students only having one recess.

A five year old in kindergarten puts in a 10 hour day, if you include their nightly work; thinking about it makes me sad for these kids. When my kids entered kindergarten, it was a half day. It was a wonderful experience; it was a place for them to learn and to grow; it was just enough. Starting 1st grade was a little overwhelming at first, getting use to being at school all day and the additional homework.

  • Cognitive (learning, thinking, problem-solving)
  • Counts 10 or more things
  • Can draw a person with at least 6 body parts
  • Can print some letters or numbers
  • Copies a triangle and other geometric shapes
  • Knows about things used every day, like money and food

Due to the Common Core and testing pressures, children in kindergarten are now expected to learn to read. Kindergarten, writes Erika Christakis in The Atlantic, has changed, and not for the better.

“One study, titled “Is Kindergarten the New First Grade?,” compared kindergarten teachers’ attitudes nationwide in 1998 and 2010 and found that the percentage of teachers expecting children to know how to read by the end of the year had risen from 30 to 80 percent. The researchers also reported more time spent with workbooks and worksheets, and less time devoted to music and art.

What Happened to Kindergarten?

I have been meeting with teachers with Mike Matthews and what I have learned, there are no more play times for our children during their day. Yes, every grade in elementary school has recess but kindergarten students are being pushed and pushed and pushed. They do not have extra recess. They do not dress up or play house. They do not allow for make believe. Our kindergarten children are in school all day without a nap or any down time.

Both of my children (both had an IEP entering kindergarten) went to kindergarten for 2 1/2 hours a day and learned their letters and numbers, even mastered a little bit of reading but most of all they learned to love school. They learned to use their minds to pretend and to have dreams and they made friends. We made cupcakes, we had class parties, and we had fun all in 2 1/2 hours. We have taken all that away from them. We are creating a generation of children who will grow up being stressed or disliking school.

I thought kindergarten was suppose to be fun, letting children explore. I am so thankful that my children did not have to go to school for the entire day, they are five years old and have nine to ten hour days, think about it. They are sitting behind tables working all day long with no fun. Children learn at that age by exploring, creating and watching other children. When is this craziness going to stop?

How many Delaware students with disabilities are also low income students?

In 2014, the Department of Education reported on DOE’s School Profile Page 35% of our Delaware public school students are low income and another 13.9% are students with disabilities. The September 30th Enrollment number for the 2014-2015 school year reported that 134,932 students were enrolled in Delaware public schools.

The total number of students attending public school in Delaware is reported to be 134,932 with 47,226 being low income students and 18,756 students being students with disabilities.

I asked the Department of Education how many of the 18,756 students with disabilities are low income and their answer was 45% of the students with disabilities are also low income students 8,440.

Delaware provides additional funding for students with disabilities, there are three categories: Basic Special Education, Intensive Special Education, and Complex Special Education. Currently, Delaware does not fund a Basic Special Education student who is enrolled in Kindergarten through 3rd grade, go to § 1703 Unit of pupils for more details.

  • Preschool — 12.8
  • K-3 — 16.2
  • 4-12 Regular Education — 20
  • 4-12 Basic Special Education (Basic) — 8.4
  • Pre K-12 Intensive Special Education (Intensive) — 6
  • Pre K-12 Complex Special Education (Complex) — 2.6

January 2015, I introduced a bill, House Bill 30, which would add Basic Special Education funding for grades Kindergarten to 3rd grade. The House Education Committee released it and it was assigned to the House Appropriations Committee in March.

This bill provides State funding to kindergarten through third grade for basic special education. State funding already occurs for intensive and complex special education during these grades. Currently the basic special education funding runs from fourth through twelfth grade. This bill is an effort to promote earlier identification and assistance for basic special education needs which should then mitigate costs over the long term.
  • 81% of our enrolled pre-k students were identified with a disability.
  • There are currently 5,843 students (pre-k thru 3) identified last year in special education.
  • In 2013-2014 67.89% of 3rd grade special education students were below standards compared to 24.34% of general education 3rd grade students.
  • US DOE issued a report in June 2014 stating that Delaware was one of three states that was identified as “Needs Intervention” with respect to special education. The US DOE has targeted Delaware for federal intervention.
  • 3rd grade is an important year for reading; this is the year that students move from learning to read, decoding words using their knowledge of the alphabet – to reading to learn.
  • 3rd grade students who lack proficiency in reading are four times more likely to become high school dropouts.
  • 3rd grade proficiency is crucial for continued academic success.
  • House Bill 30 would add 136 more special education teachers to charters and district schools.
  • Delaware school districts every year have to apply for a class size waiver Title 14 – Chapter § 1705A (c) if their Kindergarten thru 3rd grade classrooms exceeds 22 students on the last school day in October in ELA, Math, Science and Social Studies. The local school board may vote to waive this at a public meeting before December 1st of each year. This bill would help to reduce class size in grades Kindergarten through 3rd grades.
  • The extra teachers will also help with Response to Intervention.
  • RTI is a practice of providing high quality instruction and interventions matched to a student’s need.
    • Tier 1 includes all students,
    • Tier 2 students with insufficient progress in Tier 1 in reading.
    • Tier 3 students are students who have not made progress in Tier 1 or Tier 2.
  • I surveyed the 5 school districts with regards to their RTI numbers. A total of 23,550 RTI students including 3,346 students with a disability are either in Tier 1, 2 or 3. No additional resources are given to the districts in order to support this initiative.
